§ 32-54. Fitness for duty and substance abuse policy.

  • (a)

    The village recognizes that the use of legal, illegal, and unauthorized drugs and alcohol are serious problems which may endanger municipal employees, officers, officials, and others in the workplace. The basic aspects of this section are required to provide a safe working environment.

    (b)

    In order to assist in maintaining a safe working environment, the village prohibits the use or abuse, presence in the body of, or reporting to work impaired from, prescribed or over-the-counter medication, alcohol, illegal substances, and/or other conditions which impair performance by its employees or officers while engaged in municipal business on or off municipal premises. Furthermore, the village prohibits the possession, bringing onto municipal premises, transfer, storage, concealment, transportation, promotion, or sale of illegal or unauthorized drugs, alcohol, or related paraphernalia while on duty by any municipal employee or officer, except in the course of law enforcement by its police officers and court personnel.

    (c)

    Prohibited under the provisions of subsections (a) and (b) of this section are:

    (1)

    Illegal drugs, unauthorized controlled substances, look-alikes, inhalants of abuse, designer and synthetic drugs (including the presence or any detectable amount in the employee or officer while working), or any other unauthorized drugs or abnormal or dangerous substances which may affect an employee's or officer's mood or sense, responses, motor functions, or which may alter and/or affect the employee's or officer's perception, performance, judgment, reactions, or senses while working.

    (2)

    Unauthorized alcohol or intoxicating beverages.

    (3)

    The presence of an employee or officer whose blood alcohol level is at or above 0.05 percent during working time.

    (4)

    Drug-related paraphernalia.

    (5)

    Prescription drugs (legally controlled substances).

    a.

    No employee or officer shall allow any other person to consume a drug prescribed for the employee or officer.

    b.

    No employee or officer shall consume more than the prescribed amount.

    c.

    Each employee or officer shall inform his supervisor if the medication could cause hazardous side effects or if the drug presents a safety risk while working.

    d.

    The medication should remain in the original container and be in the employee's or officer's name.

    e.

    The medication should be no older than one year.

    (d)

    The use of drugs or medications prescribed by a licensed physician for the employee or officer is permitted, provided that the drug or medication will not affect the employee's or officer's work performance.
