§ 2-26. Calling and notice of special meetings.

  • (a)

    Power to call special meetings. Special meetings of the mayor and board may be called by the mayor or by a majority of the members of the board.

    (b)

    Method of giving notice to mayor and board. The mayor may call a special meeting of the mayor and board and shall cause a written notice, bearing the signature of the mayor and the date of the notice, to be served upon the members of the board by the chief of police. The notice shall be attested to by the clerk, and the chief of police shall make his return to the clerk showing, on the return of each notice, the time and method of service. Method of service shall be personal or domiciliary. When service is domiciliary, the chief of police shall serve the notice upon a member of the board's household or upon the board's employee, who is of competent age and mental capacity.

    (c)

    Notice. A majority of the board may call a special meeting of the mayor and board and the members of the board calling the special meeting shall cause a written notice, bearing the signatures of the majority of the board and the date of the notice, to be served upon the mayor and the other members of the board by the chief of police. The notice shall be attested to by the clerk and the chief of police shall make service and his return in the same as in the case of a special meeting called by the mayor.

    (d)

    Content of notice. The notice shall state the place, date, and time the special meeting is to be held; however, no special meeting can be held, except in the case of extraordinary emergency, until the next calendar day subsequent to the date of the notice of the calling of the special meeting. The notice shall also specify the business to be considered at the special meeting.

    (e)

    Times at which special meetings are to be held. Except in the case of extraordinary emergency, no special meeting of the mayor and board shall be convened until the next calendar day subsequent to the date of the notice of the calling of the special meeting, and shall not be convened before 8:00 a.m. or after 10:00 p.m. of the day set for the special meeting. The time upon which a special meeting of the mayor and board can be convened shall be on such an hour as is most practical and afford the greatest attendance by the public.

    (f)

    Minutes of special meetings. The clerk shall record the minutes of all special meetings in the same manner as minutes of the regular meetings of the mayor and board are recorded, except that the clerk shall record and file copies of the notice of the special meeting and the returns of the chief of police of the notices into the records of the meetings of the mayor and board.

    (g)

    Notice of special meetings to the public. Written public notice shall be given by the mayor, or cause the same to be done by the clerk, of all special meetings. Copies of the notice shall be posted, at least 24 hours prior to the time upon which the special meeting is to be convened, at the main entrance of the place where the special meeting is to be held and as close as is legally possible to the entrance of the United State Post Office within the corporate limits of the village. The written public notice shall state the time, date, and place of the special meeting and shall specify the business to be considered at the special meeting.

    (h)

    Business to be considered. No business except that specified in the notice of the special meeting shall be considered at the special meeting unless approved by two-thirds of the board members present at the meeting.

    (i)

    Meetings called during extraordinary emergency. The mayor or any board member may call an emergency meeting of the mayor and board. The members of the board and the mayor shall be notified of the meeting in the most practical manner available, and the purpose of the meeting may be stated in general terms. Public notice shall not be required; however, the official calling the meeting shall cause such notice of the meeting to be made to the public in such manner as is appropriate and circumstances permit.
