§ 28-142. Simple battery of a child welfare worker.

  • (a)

    Definition.

    (1)

    The term "simple battery of a child welfare worker" means a battery, other than a second degree battery or an aggravated battery, committed without the consent of the victim when the offender has reasonable grounds to believe the victim is a child welfare worker working in the performance of employment duties who has presented proper identification.

    (2)

    For purposes of this section, the term ""child welfare worker" shall include any child protection investigator, family services worker, foster care worker, adoption worker, any supervisor of the same, or any person authorized to transport clients for the agency.

    (b)

    Whoever violates this section shall be fined not more than $500.00 and imprisoned not less than 15 days nor more than 60 days without benefit of suspension of sentence.
