§ 26-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Dwelling unit means a structure or a portion of any structure designed, arranged and used for one or more persons living as a single housekeeping unit with cooking facilities, but not including units in hotels, motels, boardinghouses or other similar establishments.

    Manufactured home means a structure defined by and constructed in accordance with the National Manufactured Housing Construction and Safety Standards Act of 1974 amended, 42 USC 5401 et seq. The definition at the date of adoption of this part is as follows: The term "manufactured home" means a structure transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width by 40 feet or more in length, or, when erected on site, is 320 or more square feet; and which is built on a permanent chassis and foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein; except that such term shall include any structure which meets all the requirements of this subsection except the size requirements and with respect to which the manufacturer voluntarily files a certification required by law and/or regulation of the federal government, its agencies and departments and the state, its agencies and departments and complies with the standards established.

    Manufactured skirting means skirting produced by an organized business, group, association, corporation or individual, whose purpose, or one of its purposes for being in existence, is to produce skirting for the sale to the general public at a profit.

    Mobile home means any dwelling unit originally fabricated so as to be or allow it to be movable. Any such unit shall be considered as a mobile home, even though the unit has subsequently been made immovable. The term "mobile home" means and includes:

    (1)

    A structure, transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width by 40 feet or more in length, or, when erected on site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities and includes the plumbing, heating, air conditioning, and electrical systems contained therein manufactured prior to June 15, 1976.

    (2)

    If manufactured after June 15, 1976, the minimum requirements for a mobile home within the corporate limits of the village shall be ten body feet or more in width by 60 feet or more in length, or when erected on site is 600 square feet or more of living area.

    (3)

    The siding of the mobile home shall be painted metal, vinyl, masonite, wood or other compatible material meeting the Housing and Urban Development (HUD) regulations or the Louisiana Manufactured Mobile Home Builders Association Code. The outside appearance shall be maintained during the time that the mobile home is located within the corporate limits of the village.

    (4)

    All mobile homes must meet the manufacturing standards established by the 1994 requirements of Housing and Urban Development (HUD) or the Louisiana Manufactured Mobile Home Builders Association Code.

    Nonconventional dwelling, single-family, means a structure containing not more than one dwelling unit designed for residential use which meets or exceeds the following standards:

    (1)

    Minimum square footage of this type of dwelling unit shall be 600 square feet.

    (2)

    The roof shall have a roof pitch as required by Housing and Urban Development (HUD) and the Louisiana Manufactured Mobile Home Builders Association and shall have a surface of wood shakes, asphalt composition, wood shingles, fiberglass, metal, or other material approved by the building inspector.

    Other manufactured homes means a manufactured home not meeting the definition of "nonconventional dwelling, single-family."

    Other terms. Other terms in this chapter shall be given their common meaning.

    Skirting means panels or underpinning for mobile homes, which mobile homes are sometimes referred to as trailers or manufactured homes, which protects the mobile home from natural elements that can damage the undercarriage of the mobile home, and which also provides insulation against harsh weather conditions and can prevent animals from getting under the mobile home.
