§ 16-47. Burning of trash and other material; regulation.

  • (a)

    No person shall burn any trash, garbage, or substance on or in any public street, alley, park, or public place.

    (b)

    Except as prohibited in subsection (a) of this section, the burning of trash, grass, leaves, brush, or debris in the village shall be permitted, provided that all the conditions of this section are strictly complied with for the safety of the village and its residents.

    (c)

    No fire is to be left unattended in the village. Any fire ignited in the village shall be contained, so as not to spread any further than the size of its initial ignition.

    (d)

    Anyone igniting a fire in the village for the purpose of burning trash shall have a water hose or other available means to extinguish the fire available nearby, in the event that rapid extinguishment is necessary.

    (e)

    No fire shall be started nor trash, grass, leaves, brush, or debris burned under extreme wind conditions, and a fire shall be restricted to a reasonable size that can be maintained by the individual igniting such fire without the aid of any other individual.

    (f)

    No fire ignited for the purpose of burning trash, grass, leaves, brush, or debris in the village shall be ignited so as to cause hazard to surrounding buildings, individuals or other adjoining properties. Further, no fire shall create a nuisance by permitting smoke or noxious odors to encroach upon any other person in the village.

    (g)

    No fire shall be ignited for such purposes, when the fire shall pose a hazard to life or property of others, unless prior notice has been given to the fire department.

    (h)

    No material which is toxic or hazardous to the environment shall be burned within the village.
